Vaccination Guidance For Employers In Colorado

On December 16, 2020, the Equal Employment Opportunity Commission (EEOC) updated its guidance titled “What You Should Know About COVID-19 and the ADA, the Rehabilitation Act, and Other EEO Laws,” to include information on how employers may approach the COVID-19 vaccine.

The Colorado Department of Public Health & Environment is distributing COVID-19 vaccines to enrolled providers (enrollment requires credentials/licenses, program provider agreement, and other training and processes).

The updated guidance from the EEOC on employee vaccines is similar to earlier guidance on influenza outbreaks. The guidance recognizes that employers may require vaccination without violating federal or state law, but further explains that employers must follow federal law when employees decline vaccinations.
